Agreement to our legal terms
We are AskBefore UG (haftungsbeschränkt) ("AskBefore", "we", "us", or "our") operating https://www.askbefore.eu/ (Website) and https://app.askbefore.eu/ (Platform), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and AskBefore UG (haftungsbeschränkt), concerning your access to and use of the Services.
You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.
IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason.
We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.
These Legal Terms also incorporate by reference our Privacy Policy, which describes how we collect, use, store, and protect your personal information when you use our services. The Privacy Policy includes important information on the processing of sensitive health data, your rights under applicable data protection laws (such as GDPR), and how to contact us regarding privacy concerns.
The Services and any information provided through them are not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would violate laws or regulations, or would subject us to any registration or regulatory requirements.
Individuals who choose to access the Services from locations outside of our primary operating jurisdictions do so at their own initiative and are solely responsible for ensuring that their use complies with all applicable local laws and regulations.
Where available, the Platform enables users to purchase services directly from testing providers. Payments and refunds are governed by our Cancellation & Refund Policy.
AskBefore operates as an online intermediary platform that enables users to find, compare, and book STI testing and related services offered by independent clinics, laboratories, and other healthcare providers listed on the Platform.
AskBefore does not provide medical, diagnostic, laboratory, testing, healthcare, counselling, treatment, or emergency services. The selected provider is solely responsible for providing the booked service.
The contract for the provision of the selected provider's service is concluded directly and exclusively between the user and the selected provider. AskBefore is not a party to that contract and does not become a party to it at any point.
The selected provider is solely responsible for the availability, performance, quality, safety, legality, documentation, invoicing, cancellation, refund, and compliance of its services.
Search results, map pins, provider listings, and available booking options may be displayed based on the user's selected test, location, search area, filters, and available provider parameters.
These parameters may include sample type, price, availability, appointment capacity, turnaround time, provider location, opening hours, services offered, and other operational information available through the Platform.
AskBefore does not currently offer paid ranking, sponsored placement, or paid promotion in search results or map views. Providers cannot purchase a higher position in search results or map views. Provider fees do not determine the position of map pins, provider listings, or search results.
AskBefore may determine the technical presentation, ordering, grouping, filtering, and visibility of search results, map pins, and provider listings at its reasonable discretion in order to operate the Platform, improve user experience, maintain accuracy, and manage legal, operational, payment, compliance, or user safety risks.
Provider listings, prices, availability, appointment times, opening hours, turnaround times, sample types, contact details, booking settings, cancellation rules, and other provider-related information may be provided, updated, approved, or managed directly by the relevant testing provider through the Partner Portal or otherwise supplied to AskBefore by the provider.
Testing providers are responsible for ensuring that the information they provide is accurate, complete, current, lawful, and not misleading.
AskBefore takes reasonable steps to keep provider information accurate and up to date, but AskBefore does not guarantee that all provider information will always be complete, current, or error-free.
AskBefore may update, hide, suspend, restrict, or remove provider listings, locations, services, booking availability, or payment functionality where information appears inaccurate, outdated, misleading, incomplete, unlawful, or where AskBefore considers this necessary to manage legal, operational, payment, compliance, or user safety risks.
If a user believes that provider information displayed on AskBefore is inaccurate, outdated, misleading, or incomplete, including information about prices, availability, appointment times, location, sample type, turnaround time, opening hours, or cancellation terms, the user may report it to AskBefore through the Platform or by contacting support@askbefore.eu.
AskBefore may review such reports, contact the relevant provider, request correction, update information, restrict booking availability, or temporarily hide or remove a listing where AskBefore considers this necessary to protect users, maintain platform accuracy, or manage legal, operational, payment, compliance, or safety risks.
AskBefore provides a separate booking facilitation service consisting of finding, presenting, and processing the user's booking with the selected provider through the Platform ("Booking Service").
AskBefore's Booking Service is separate from the medical, laboratory, testing, diagnostic, healthcare, or related service provided by the selected provider.
AskBefore's Booking Service is generally fully performed once the booking has been confirmed and transmitted to the selected provider.
Where online payment is available and selected, payment is made directly to the selected provider through the provider's payment infrastructure, currently Stripe Connect Direct Charge.
AskBefore does not receive, hold, control, or settle user funds. AskBefore does not charge users any commission, markup, application fee, platform fee, or service fee on top of the provider's price.
The selected provider is responsible for payment processing, refunds, chargebacks, disputes, invoices, receipts, accounting records, tax treatment, and all related payment obligations connected with the provider's service.
Where a booking is made without online payment through the Platform ("Book & Pay at Location"), AskBefore only facilitates the booking. No payment is processed through the Platform.
In such cases, payment is made directly to the selected provider at the provider's location. All payment, receipt, cancellation, refund, no-show, late arrival, and payment-related terms are determined by the selected provider.
Before completing an online paid booking, users are shown or given access to the selected provider's cancellation and refund policy through the Platform checkout.
The Provider Cancellation Policy may affect whether a cancellation is possible, whether a refund is available, and the amount of any refund.
Users should review the Provider Cancellation Policy before confirming and paying for a booking.
The selected provider is responsible for the content, accuracy, legality, application, and enforcement of its Provider Cancellation Policy.
Where available, users may request cancellation of an appointment through the Platform.
A cancellation request submitted through the Platform is not a withdrawal from AskBefore's Booking Service. It is a request relating to the appointment with the selected provider.
Submitting a cancellation request does not guarantee cancellation or refund. The selected provider is responsible for handling the request and determining any refund according to the Provider Cancellation Policy and applicable law.
AskBefore may assist by forwarding or displaying the cancellation request to the selected provider, but AskBefore does not approve, decline, initiate, reverse, or process refunds.
Refunds are processed exclusively by the selected provider or by the provider's payment processor.
AskBefore does not process, initiate, approve, decline, reverse, or control refunds.
If the selected provider cancels the appointment, is unable to provide the booked service, or fails to provide the service for reasons attributable to the provider, the user will generally be entitled to a full refund, unless mandatory applicable law provides otherwise.
If the user does not attend the appointment, arrives too late, or requests cancellation for reasons not attributable to the provider, the user may not be entitled to a full refund. The applicable refund amount is determined by the selected provider according to the Provider Cancellation Policy and applicable law.

AskBefore provides a separate Notice of Right of Withdrawal / Widerrufsbelehrung in relation to AskBefore's Booking Service.
That notice applies only to AskBefore's Booking Service. It does not determine whether any withdrawal, cancellation, refund, or similar right applies to the medical, laboratory, testing, diagnostic, healthcare, or related service provided by the selected provider.
Where the user expressly requests immediate processing of AskBefore's Booking Service and the Booking Service has been fully performed, the user may lose the right of withdrawal in respect of AskBefore's Booking Service.
AskBefore's Booking Service is generally fully performed once the booking has been confirmed and transmitted to the selected provider.
Any cancellation or refund request relating to the appointment or the selected provider's service is governed by the Provider Cancellation Policy, the selected provider's terms, and applicable law.
Test packages, test groupings, service descriptions, sample type information, turnaround time information, and other informational content on the Platform are provided for general informational, comparison, and booking purposes only.
They do not constitute personal medical advice, diagnosis, treatment, counselling, or an individual test recommendation.
Final test selection, sample type, timing, medical suitability, and interpretation of results should be discussed with a qualified healthcare professional or the selected provider.
The final testing method, sample type, or service details may be confirmed by the selected provider according to applicable medical guidelines, clinical judgement, provider procedures, and applicable law.
AskBefore does not make medical, clinical, diagnostic, or treatment decisions.
AskBefore helps users compare provider information and make bookings based on information supplied by testing providers. Before confirming a booking, users should review the booking details shown on the Platform, including the selected provider, location, test or package, sample type, appointment time, price, and cancellation terms.
AskBefore does not guarantee that a specific test, package, sample type, or testing method is medically suitable for a particular user. Medical suitability, final test selection, sample type, timing, and interpretation of results should be discussed with a qualified healthcare professional or the selected provider.
The Platform provides general informational, comparison, and booking-related functionality only.
AskBefore does not provide medical advice, diagnosis, treatment, counselling, laboratory services, testing services, or emergency services.
Users should consult a qualified healthcare professional for medical questions, diagnosis, treatment decisions, test selection, interpretation of results, or urgent health concerns.
The Platform should not be used as a substitute for professional medical advice or emergency medical care.
Our intellectual property
We (AskBefore UG (haftungsbeschränkt) are the owner or authorized licensee of all intellectual property rights related to our Services. This includes all source code, databases, software, website designs, functionality, audio, video, text, photographs, graphics, and any trademarks, service marks, and logos (collectively referred to as the “Content” and “Marks”).
All Content and Marks are protected by applicable copyright, trademark, and intellectual property laws, as well as international treaties.
Unless otherwise stated, all Content and Marks provided via the Services are for your personal, non-commercial, or internal business use only and are offered “AS IS”.
Your use of our services

We reserve the right to suspend or terminate your account and deny access to the Services if any information you provide is false, inaccurate, outdated, or incomplete, or if we reasonably believe you have violated these representations.
The Partner Portal is intended for partner organizations that work with AskBefore, including testing providers and other healthcare or service providers.
If you access or use the Partner Portal on behalf of a partner organization, you confirm that you are authorized to do so and to act on behalf of that partner organization within the role and permissions assigned to your account.
Your access to the Partner Portal may be limited based on your assigned role, organization, location, assigned locations, or other access scope. You agree not to access, modify, or attempt to modify any information outside your assigned permissions.
The partner organization is responsible for ensuring that its team members are authorized to access the Partner Portal and that their assigned roles, permissions, and access scopes are accurate and kept up to date.
Relationship with the Partner Agreement
If your organization has entered into a Partner Agreement with AskBefore, that Partner Agreement governs the commercial and operational relationship between AskBefore and the partner organization.
These Terms of Use apply to individual access to and use of the Services, including the Partner Portal.
In case of conflict between these Terms of Use and the Partner Agreement regarding partner obligations, the Partner Agreement will prevail, unless expressly stated otherwise.
Partner-provided information
Partner organizations and their authorized team members may add, update, submit, approve, publish, or manage information in the Partner Portal, including information about locations, contact details, services, prices, packages, discounts, availability, booking settings, payment provider settings, order-related statuses, suggestions, and other operational information related to the partner organization's use of AskBefore.
The partner organization is responsible for ensuring that all information it provides, approves, publishes, or manages through the Partner Portal is accurate, complete, current, lawful, and not misleading.
Some partner-provided information may be displayed to users on AskBefore, including in search results, map views, order flows, booking flows, order confirmations, and related service communications.
Location publication
When a partner organization publishes a location, that location may become visible to users on AskBefore, including in search results and map views.
The partner organization is responsible for ensuring that published location information is accurate, current, and suitable for display to users.
If a trial period applies to a location, the trial period starts when that location is published for the first time, unless the Partner Agreement states otherwise. Unpublishing and later republishing the same location does not restart the trial period.
Location contact details
Partner organizations may provide contact details for their locations, such as an email address or phone number that users can use to contact the location about bookings, rescheduling, cancellations, visits, orders, or related questions.
The partner organization is responsible for ensuring that these contact details are accurate, current, and appropriate for user communications.
These contact details may be displayed or otherwise made available to users where necessary to support communication regarding bookings, appointments, visits, cancellations, rescheduling, payments, or related operational matters.
Partner suggestions and recommendations
Partner organizations and their authorized team members may submit suggestions or recommendations through the Partner Portal, including suggestions for STI tests, packages, or other service offerings.
AskBefore may review these submissions and decide, at its discretion, whether to add, reject, modify, or further evaluate any suggested service, package, or offering.
Submitting a suggestion does not guarantee that AskBefore will add it to the Services.
AskBefore Booking
AskBefore Booking is available only to partner organizations that have agreed to use this feature.
If a partner organization has not previously agreed to use AskBefore Booking, it may request activation by contacting AskBefore at partner@askbefore.eu.
When AskBefore Booking is enabled for a partner organization or location, authorized Partner Portal users may configure booking availability, appointment schedules, capacity, and related booking settings.
The partner organization is responsible for ensuring that booking availability, schedules, capacity, and related information are accurate, current, and suitable for users.
Payment provider and payment integration settings
Some partner organizations may choose to use an integrated payment provider, such as Stripe Connect or another payment provider supported by AskBefore. In these cases, AskBefore may enable payment provider functionality for that partner organization.
Other partner organizations may use a simplified integration where AskBefore redirects users to a link provided by the partner organization in the Partner Portal for each location. This link should lead to the partner organization's public page where the relevant service is listed, instead of using an integrated payment provider within AskBefore.
The partner organization is responsible for ensuring that any payment provider settings, payment integration settings, or links provided for simplified integration are accurate, current, lawful, and suitable for users.
A partner organization's payment integration setup may change over time, depending on the partner organization's preferences, operational needs, or agreement with AskBefore.
Orders and order-related actions
Authorized Partner Portal users may view and manage orders according to their assigned role and access scope.
The partner organization is responsible for handling orders, appointments, cancellations, completed statuses, user communications, and related operational actions in accordance with the Partner Agreement and applicable law.
Partner Portal activity records and History Log
AskBefore may record actions taken in the Partner Portal for security, auditability, operational transparency, support, and compliance purposes.
These records may include actions such as account activation, sign-ins, team invitations, role and access changes, notification setting changes, location changes, publication or unpublication of locations, service and price updates, package updates, booking schedule changes, payment provider changes, suggestions, order-related actions, and other operational actions in the Partner Portal.
Partner Portal activity records may be shown in the History Log to authorized users depending on their role and access scope. Users can only see activity that is relevant and appropriate for their role, organization, location, or assigned locations.
Partner Portal email notifications
Partner Portal users may receive service-related email notifications about activity and updates relevant to their role and access scope.
Users can manage optional email notifications in their account settings. Some notifications may be required for certain roles or service functionality and cannot be turned off.
Some notifications may include another team member's name, role, and details of the action they performed, where this is relevant to the recipient's role and access scope.
Account responsibility
You are responsible for keeping your Partner Portal login details secure and for any activity carried out through your account.
You must not share your login credentials with another person or allow another person to use your account.
If you believe your account has been accessed without authorization, you should notify AskBefore as soon as possible.
Suspension or restriction of access
AskBefore may suspend, restrict, or remove access to the Partner Portal where necessary to protect the Services, users, partner organizations, or AskBefore, including where we reasonably believe that access has been misused, credentials have been compromised, information is inaccurate or misleading, or continued access may create operational, legal, security, or compliance risks.
You may not access or use the Services for any purpose other than that for which the Services are made available. You may not use the Services in connection with any commercial activity except as explicitly approved by us.
As a user of AskBefore, you agree not to:
As part of using the Services, you may have the ability to create and share an Exchange Page with a selected recipient via the platform. The Exchange Page may include your STI test results, an optional message to your partner, and/or an optional request for your partner to complete specific STI tests (together, "Contributions"). These Contributions are intended to provide personal, emotional, or practical context and are only visible to the intended recipient via the platform.

By using the Services, you may provide two types of contributions:
(a) end-to-end encrypted content (such as STI test results, STI test requests, and messages to partners), and
(b) unencrypted content (such as service feedback).
a) Encrypted medical data:
All Exchange Page content shared through the platform — including STI test results, requests for a partner to complete specific STI tests, and messages addressed to your partner — is protected with end-to-end encryption. We do not have access to the contents of this encrypted content, do not store decryption keys, and cannot read, view, or modify it. Only you and the intended recipient(s) can decrypt and view the encrypted content.
By submitting encrypted content, you authorize us to securely store and transmit it in encrypted form solely for its intended purpose — without access to its contents.
b) Unencrypted contributions:
Any feedback you provide about the Services (for example, bug reports, support messages, or product suggestions) may be stored and processed in readable form. By submitting this feedback, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and use it solely for the purposes of operating and improving the Services, including security, moderation (if needed), and customer support.
You retain all ownership rights to your contributions. We claim no ownership over your content and do not use it for advertising, resale, or commercial redistribution. You are solely responsible for your contributions and any legal consequences they may cause. You agree not to hold us liable for any claims related to your content.
For clarity, end-to-end encryption applies only to Exchange Page content (including STI test results, partner test requests, and partner messages). Transactional and purchase-related information—such as testing provider selection, booking details, order history, pricing, and payment status—is not end-to-end encrypted and may be processed and stored by us as necessary to provide the testing provider aggregator and payment-related services, in accordance with our Privacy Policy.

These legal terms remain in effect as long as you use the Services.
We reserve the right, at our sole discretion and without prior notice or liability, to deny access to or suspend your use of the Services (including blocking specific IP addresses), for any reason or no reason at all. This may include, but is not limited to, violations of these legal terms, applicable laws, or our internal policies. We may also delete any content or information you have posted, without prior warning.
If your account is terminated or suspended, you are prohibited from creating a new account under your own name, a false or borrowed name, or the name of any third party — even if you act on their behalf.
We also reserve the right to pursue legal remedies, including but not limited to civil, criminal, or injunctive actions, as appropriate.
We may change, modify, update, suspend, or remove any part of the Services at any time, at our sole discretion and without prior notice. While we may notify users of significant changes, we are not obligated to do so.
We do not guarantee continuous availability of the Services. Technical issues, maintenance, upgrades, or external factors may cause delays, interruptions, or outages. You acknowledge that such disruptions may occur and agree that we are not liable for any resulting damages, losses, or inconveniences.
Nothing in these legal terms obligates us to maintain or support the Services, or to provide future updates, bug fixes, or improvements.

These Legal Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. You irrevocably agree that the courts located in Germany shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Legal Terms or their subject matter.
Informal negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to negotiate any Dispute informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other.
Binding arbitration
Any Dispute that cannot be resolved through informal negotiations shall be finally settled by arbitration under the Arbitration Rules of the German Institution of Arbitration (DIS). The number of arbitrators shall be one. The seat (legal place) of arbitration shall be Berlin, Germany. The arbitration shall be conducted in the English language. The governing law of these Legal Terms shall be the laws of Germany.

We do not control or verify this external data and therefore cannot guarantee its accuracy or completeness.
We reserve the right to correct, update, or remove any information on the Services at any time and without prior notice, but we are not responsible for errors or omissions originating from third parties.
The Services are provided on an “as is” and “as available” basis. You use the Services at your own risk.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
We do not guarantee that the Services will be error-free, secure, uninterrupted, or free from harmful components. Specifically, we assume no responsibility or liability for:

Any interaction or transaction with third-party providers is solely between you and that provider. Use your own best judgment and exercise caution.
To the maximum extent permitted by law, neither we nor our directors, employees, agents, or affiliates shall be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages. This includes — but is not limited to — loss of profits, revenue, data, or goodwill, or any damages related to:

Some jurisdictions do not allow certain limitations on liability or the exclusion of implied warranties, so these provisions may not apply to you. In such cases, your statutory rights remain unaffected.
You agree to indemnify, defend, and hold harmless us, our affiliates, partners, employees, and agents from any claims, liabilities, damages, costs, or expenses — including reasonable legal fees — arising out of or related to:

The Services involves the processing of health data, which is classified as a "Special Category of Personal Data" under Art. 9 of the GDPR. This includes the secure hosting of your encrypted medical files. When uploading medical test results, you are asked to provide your explicit consent for us to process this data for the specific purpose of facilitating your storage and sharing of such information. You may withdraw this consent at any time.
Where booking or purchase-related information may reveal health-related data, such as the selected STI tests or test package, we request your explicit consent before the purchase is completed, as further described in our Privacy Policy.
By using the Services, contacting us electronically, or submitting any online forms, you agree to receive all communications from us in electronic form. This includes agreements, legal notices, updates, or disclosures.
You agree that electronic communications satisfy any legal requirement for written documentation.
You waive any right to require non-electronic signatures, paper documents, or physical delivery of records unless required by law in your jurisdiction.
These Legal Terms, together with our Privacy Policy and Cancellation & Refund Policy, constitute the entire agreement between you and us regarding use of the Services. Our failure to enforce any provision of these Legal Terms will not be considered a waiver of that provision.
These Terms apply to the fullest extent allowed by law. We may assign any of our rights or obligations at any time. We are not liable for any delay or failure to perform due to causes beyond our reasonable control.
If any part of these Terms is found to be invalid or unenforceable, the rest will remain fully effective. No partnership, joint venture, or employment relationship is created by these Terms. These Terms will not be construed against us simply because we drafted them.
