This notice applies to AskBefore's booking facilitation service where a user books, requests, or confirms an appointment or service through the Platform, including bookings with online payment and bookings without online payment.

This notice relates only to AskBefore's booking facilitation service. It does not apply to the medical, laboratory, diagnostic, testing, healthcare, or related services provided by the selected provider. Any cancellation, refund, no-show, late-arrival, payment, or similar rights and obligations relating to the selected provider's service are governed by the selected provider's terms and applicable law.

Important: What this notice covers

This notice relates solely to the booking facilitation service provided by AskBefore (the "Booking Service") — that is, the service of finding, presenting, and processing your booking with a testing provider through the Platform. It does not relate to the medical, laboratory, or testing services provided by the selected testing provider. Your rights in relation to those services are governed by the selected provider's own terms and applicable law.

1. Your Right of Withdrawal

You have the right to withdraw from the contract for AskBefore's Booking Service within 14 days without giving any reason.

The withdrawal period is 14 days from the date on which the contract is concluded, which is the date on which your booking is confirmed.

To exercise your right of withdrawal, you must inform AskBefore of your decision by means of an unambiguous written statement sent by email or post. Verbal notice of withdrawal — including in person, by telephone, or by any other oral means — is not accepted and will not be effective. You may use the model withdrawal form set out in Section 4, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient that you send your written communication before the withdrawal period has expired.

2. Exceptions to the Right of Withdrawal — Loss of Withdrawal Right

2.1 Immediate processing of the Booking Service

When you place a booking through AskBefore, you expressly request that AskBefore begins performing the Booking Service immediately — that is, that AskBefore processes and confirms your booking before the 14-day withdrawal period has expired.

By making this express request at the time of booking, and by acknowledging that you are aware of the consequences, you agree that:

  • AskBefore may begin performing the Booking Service immediately upon your booking confirmation; and
  • once the Booking Service has been fully performed (i.e. your booking has been confirmed and transmitted to the provider), you lose your right of withdrawal in respect of the Booking Service, pursuant to § 356 Abs. 4 BGB in conjunction with § 312g Abs. 2 Nr. 1 BGB.

This loss of the right of withdrawal applies only to AskBefore's Booking Service. It does not affect any rights you may have in relation to the medical or testing services provided by the selected testing provider.

2.2 Applicable legal basis

The above exception is based on § 312g Abs. 2 Nr. 1 BGB (service contracts where the service has been fully performed with the consumer's prior express consent before the withdrawal period expires) and, where applicable, § 312g Abs. 2 Nr. 9 BGB (contracts for healthcare services provided by healthcare professionals). The applicable exception depends on how the selected provider classifies its services under applicable law.

3. Consequences of Withdrawal

If you validly withdraw from the contract for AskBefore's Booking Service before AskBefore has completed the Booking Service, AskBefore will stop providing the Booking Service to the extent it has not yet been completed. AskBefore's Booking Service is generally completed once your booking is confirmed or your booking request has been sent to the selected provider.

This withdrawal applies only to AskBefore's Booking Service. It does not cancel, withdraw, or determine your rights in relation to the testing, medical, laboratory, diagnostic, healthcare, or related service provided by the selected provider.

Any cancellation, refund, reimbursement, no-show, late-arrival, payment, or similar matter relating to the selected provider's service is governed by the selected provider's terms and applicable law. AskBefore may assist by forwarding your request to the selected provider, but AskBefore cannot approve, initiate, or process refunds or determine provider-service outcomes.

5. Governing Law

This notice is governed by the laws of Germany. Your statutory rights as a consumer under the laws of your country of residence are not affected by this notice.
